INCLUSION OF U.S. NUCLEAR REGULATORY COMMISSION LICENSED FACILITY TO THE JULY 19, 2005, ORDER IMPOSING ADDITIONAL SECURITY MEASURES (EA-05-007)
Dear Mr. Kansler:
On July 19, 2005, the U.S. Nuclear Regulatory Commission (NRC or Commission) issued an immediately effective Order (EA-05-007) imposing additional security measures on all licensees who may transport radioactive material quantities of concern. Attachment A to that Order contained a list of the licensees who hold licenses issued by the NRC or an Agreement State, in accordance with the Atomic Energy Act of 1954, as amended, and Title 10 of the Code of Federal Regulations (10 CFR) Part 50, 70 and 71, or equivalent Agreement State regulations.
It has come to the attention of the NRC staff that Attachment A of Enclosure 1 to the July 19, 2005, Order, failed to include your facility as listed on this letter. The NRC staff has determined that the omission was made in error and that the requirements in the Order apply to your facility.
By letter dated July 29, 2005, Entergy provided its consent to the Order pursuant to 10 CFR 2.202(d), which included Indian Point Unit 1. As such, the Commission finds that Entergy has met the 20-day response required by the Order.
Transmitted with this letter is a corrected replacement page for Attachment A of Enclosure 1 to the Order. Please contact your NRC licensing project manager if you have questions regarding this letter.
