Withdrawal of License Amendment Application to Revise Technical Specifications Regarding Steam and Feedwater Rupture Control System (SFRCS) Instrumentation Setpoints and Surveillance Intervals (License Amendment Request 03-0010, TAC No. MC0583)

Ladies and Gentlemen:

By letter dated August 25, 2003, the FirstEnergy Nuclear Operating Company (FENOC) submitted an application for an amendment to the Davis-Besse Nuclear Power Station (DBNPS), Unit Number 1, Operating License Number NPF-3, Appendix A Technical Specifications. The proposed amendment (DBNPS letter Serial Number 2960) would:

revise the Steam and Feedwater Rupture Control System (SFRCS) Instrumentation Technical Specifications to clearly identify the appropriate actions to be taken if an SFRCS instrumentation channel's output logic becomes inoperable; relocate the SFRCS Instnzmentation Trip Setpoints from the Technical Specifications; and change the Channel Functional Test frequency from monthly to quarterly for the SFRCS Instrument Channels and make the associated changes to the Trip Setpoint Allowable Values. A supplemental letter was submitted on June 4, 2004 (DBNPS letter Serial Number 3005).

Based on discussions with the NRC staff, the proposed surveillance interval increase would require additional justification. In addition, there are ongoing generic issues regarding setpoint methodology that could impact the license amendment request. The NRC staff has requested FENOC to respond to the generic issues described in a March 31, 2005 NRC letter to the Nuclear Energy Institute (ADAMS Accession Number ML050870008). Based on these considerations, FENOC requests that this license amendment request be withdrawn.
