ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that one White Significance Determination Process finding will be issued on or about July 29, 2005, to AmerGen Energy Company as a result of inspections at Three Mile Island, Unit 1 (TMI). This White finding, an issue of low to moderate safety significance, which may require additional NRC inspections, involved the licensees failure to ensure that members of its Emergency Response Organization (ERO), including key responders, received the required annual radiological response classroom retraining necessary to maintain familiarity with their specific ERO duties. Specifically, approximately 50 percent of the ERO did not receive the required annual training and would not have been considered qualified to respond to a radiological emergency for an approximate five-month period (June -
November 2004).
A Notice of Violation is included based on a violation of 10 CFR 50.47(b)(15) which requires that a licensee provide radiological emergency response training to those who may be called on to assist in an emergency. In accordance with the NRC Enforcement Policy, the Notice of Violation is considered an escalated enforcement action because it is associated with a White finding.
It should be noted that the licensee has not been specifically informed of the regulatory action.
