NRC STAFFS FIFTH STATUS REPORT ON REVIEW SCHEDULE The staff of the Nuclear Regulatory Commission (Staff) herein submits its fifth status report regarding the review schedule for the extended power uprate (EPU) application that is at issue in this proceeding.
In its Initial Scheduling Order,1 the Atomic Safety and Licensing Board (Licensing Board) directed the Staff to submit by March 15, 2005 (and monthly thereafter) a short report estimating the date when draft and final version[s] of the safety evaluation report (SER),
environmental assessment (EA) and Advisory Committee on Reactor Safeguards (ACRS) report letter will be issued. The Staff has submitted status reports on March 15, April 15, May 16, and June 15, 2005. As noted by the Licensing Board in its Memorandum and Order dated June 29, 2005,2 none of these reports transmitted an estimated schedule. In short, as a result of its continuing review of the EPU application, the Staff has identified significant areas in which additional information is needed to complete the review. information has prevented the establishment of a new review schedule.
As discussed in the Staffs letter to the licensee dated October 15, 2004,3 the Staffs review schedule for the EPU application has been impacted primarily due to concerns regarding the steam dryer analysis. On April 5, 2005, the licensee submitted the last of several supplements to the EPU application addressing the issues raised in the October 15, 2004 letter.
These supplements collectively contained a substantial amount of information that has necessitated significant Staff review time and has engendered further Staff questions. As a result, the Staff expects to issue, in the near term, approximately 200 request for additional information (RAI) questions on various topics. The licensees estimated response date (or dates) to these RAI questions is necessary before the Staff can set the schedular milestones requested by the Licensing Board.
The Staff continues to progress in its review, and will be prepared to provide the Licensing Board and the parties with its best estimate of the date of issuance of the draft and final SER, pursuant to the Licensing Boards direction, on August 3, 2005. Further, pursuant to the Initial Hearing Order, the Staff will submit an updated status report on or about August 15, 2005.
