WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NOS. MC3956 AND MC3957)

Dear Mr. Blevins:

By letter to the U.S. Nuclear Regulatory Commission (the Commission) dated August 5, 2004, TXU Generating Company LP applied for amendments to Facility Operating License No. NPF-87 and Facility Operating License No. NPF-89 for CPSES, Units 1 and 2, respectively.

The proposed amendments would have modified the facility Technical Specifications (TSs) pertaining to TS 3.7.10, Control Room Emergency Filtration / Pressurization System (CREFS).

Subsequently, by "CPSES-200501121, License Amendment Request LAR 04-05, Supplement 1, Change to Technical Specification 3.7.10, Control Room Emergency Filtration/Pressurization System (TAC Nos. MC6637 and [[Inspection Manual Chapter" contains a listed "[" character as part of the property label and has therefore been classified as invalid.) Additional Information|letter dated May 18, 2005]], the licensee withdrew the amendment request.

The Commission has approved the licensees request for withdrawal of the amendments and has filed the enclosed Notice of Withdrawal of Application for Amendments to Facility Operating Licenses NPF-87 and NPF-89 with the Office of the Federal Register for publication.

UNITED STATES NUCLEAR REGULATORY COMMISSION TXU GENERATION COMPANY, LP DOCKET NOS. 50-445 AND 50-446 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENTS TO FACILITY OPERATING LICENSES The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of TXU Generation Company, LP (the licensee) to withdraw its August 5, 2004, application for proposed amendment to Facility Operating License No. NPF-87 and Facility Operating License No. NPF-89 for Comanche Peak Steam Electric Station, Units 1 and 2, respectively, located in Somervell County, Texas.

The proposed amendments would have revised the facility Technical Specifications (TSs) pertaining to control room emergency filtration/pressurization system (CREFS). The revised TSs would have added a new condition for an inoperable control room boundary with an opening (breach) into the cable spreading room, for an extended period of time (greater than current 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />).

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the Federal Register on August 31, 2004 (69 FR 55114).
