As I have indicated to you before, almost all of the information that you will receive in the FOIA response is publicly available in the PDR under docket numbers 50-366 & 50-423. The document upon which we are soliciting comments, NUREG-1 437, Supplement 22 (Millstone DSEIS), has been available on the NRC's public website since December 3, 2004; a copy of this document was mailed to you on the same day.
All of the information that we relied upon to draw the conclusions in the document are referenced in the document, and all of the references are publicly available. Opportunity to comment on the document was also noticed in the Federal Register by N RC on December 9, 2004, and by EPA on December 10, 2004.
The comment period lasted 80 days from the date of the EPA Federal Register notice, a little more than the 75 days we have been using for license renewal DSEISs and almost double the 45 days required by NRC regulations. Therefore, we conclude that you have had adequate opportunity and information to provide comments by the comment period deadline of March 2, 2005.
As we stated at the public meeting in Waterford, Connecticut, on January 11, 2005, we will consider comments received after the March 2, 2005, deadline to the extent practicable.

Dear Mr. Emch:
We are still awaiting receipt of the records you compiled responsive to our January 24, 2005 request. Rather than share the records with us, you apparently provided them to the NRC's Freedom of Information department, which has withheld them.
We are at a loss to understand why the NRC is behaving this way.
We are awaiting receipt of the records in order to complete our filing on the draft EIS.
Should we not receive the documents by Friday, March 11, 2005, we will file our supplement on Monday March 14, 2005, together with such further communication to the NRC Commissioners and others as appears appropriate.
