ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that one White Significance Determination Process finding will be issued on or about May 5, 2005, to Nuclear Management Company, LLC (NMC) as a result of inspections at the Kewaunee Nuclear Power Plant. This White finding, an issue of low to moderate safety significance, which may require additional NRC inspections, involved the licensees inability to rapidly close the containment equipment hatch during cold shutdown conditions due to an interference. Specifically, the interference was caused by the inadequate design of a rail system which was installed in the containment to facilitate reactor vessel head replacement activities.
A Notice of Violation is included based on a violation 10 CFR Part 50, Appendix B, Criterion V, (Instructions, Procedures, and Drawings). Specifically, the licensee did not develop or have in place procedures or plans to effect a rapid removal of the interior portion of the steel rail system to allow closure of the containment equipment hatch if it became necessary to do so. In accordance with the NRC Enforcement Policy, the Notice of Violation is considered an escalated enforcement action because it is associated with a White finding.
It should be noted that the licensee has not been specifically informed of the regulatory action.
