NRC OFFICE OF INVESTIGATIONS REPORT NO. 3-2004-015

Dear Mr. Wilson:

This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI) to determine if a shift manager at Point Beach Nuclear Plant willfully failed to declare an accumulator inoperable, and whether a senior manager willfully directed the shift manager not to declare the accumulator inoperable. Based on the evidence developed during the investigation, we did not substantiate these issues. The synopsis from the OI report of investigation is enclosed.

OI Synopsis This investigation was initiated on May 24, 2004, by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region III, to determine if a Shift Manager at the Point Beach Nuclear Plant willfully failed to declare the accumulator inoperable, and whether a senior manager willfully directed the Shift Manager not to declare the accumulator inoperable.

Based on the evidence developed, this investigation did not substantiate the allegation that the Shift Manager at the Point Beach Nuclear Plant willfully failed to declare the accumulator inoperable, in violation of technical specifications.

Based on the evidence developed, this investigation also did not substantiate the allegation that a senior manager willfully directed the Shift Manager not to declare the accumulator inoperable.
