Dear Mr. Dworkin:
Your letter to Chairman Diaz dated March 18, 2005, has been referred to me for response. In your letter, you requested a meeting with the Nuclear Regulatory Commission (NRC) staff, similar to the one that occurred in June 2004, to describe further the engineering assessment conducted at the Vermont Yankee Nuclear Power Station (Vermont Yankee) in August 2004.
In addition, you were interested in the expected schedule for review of the Vermont Yankee extended power uprate (EPU) amendment request by the Advisory Committee on Reactor Safeguards. The EPU amendment request, as you are aware, is also the subject of an ongoing NRC adjudicatory proceeding.
The NRC staff has contacted the Clerk of the Public Service Board to coordinate the arrangements for the meeting you requested. The engineering inspection was performed as outlined in Chairman Diazs letter to the Vermont Public Service Board dated May 4, 2004. The NRC staff will be pleased to discuss the results of the NRC inspection and the status for resolution of the issues identified during the inspection.
Currently, the staff does not have a schedule for completion of the review of Vermont Yankees EPU amendment request. As discussed in the NRCs letter to Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. (Entergy) dated October 15, 2004, the Vermont Yankee EPU review schedule is being impacted primarily due to concerns regarding the steam dryer analysis. On April 5, 2005, Entergy submitted a supplement to the EPU application that completed a series of supplements submitted to address the concerns in the NRCs October 15, 2004 letter. The NRC staff is currently reviewing these submittals and is reassessing the review schedule. At the meeting, the staff would be prepared to update you on the schedule. We would not be able to discuss any technical details of the staffs review of the EPU amendment request since that review is ongoing.
