Fwd: DRAFT SAFETY EVALUATION REPORT FOR THE EXELON EARLY SITE PERMIT APPLICATION As discussed in the forwarded message sent to you on February 10, 2005, the NRC staff allowed 14 days for Exelon Generation Company, LLC (Exelon), in consultation with the State of Illinois and the Illinois Emergency Management Agency, to review the draft safety evaluation report (DSER) for proprietary information. By letter dated February 23, 2005, Exelon requested an additional 7 calendar days for Exelon and the State of Illinois to complete their review. Therefore, the staff is extending the proprietary review period an additional 7 calendar days.
After this proprietary review waiting period, the DSER (less any proprietary information) will be made publically available in the NRC's Public Document Room (PDR) at 11555 Rockville Pike, Rockville, MD, and on the NRC's ESP web site at http://www.nrc.gov/reactors/new-licensing/esp.html. A copy will also be made available at the Vespasian Warner Public Library.

DRAFT SAFETY EVALUATION REPORT FOR THE EXELON EARLY SITE PERMIT APPLICATION This notice is being sent to interested persons to announce the issuance of the Nuclear Regulatory Commission (NRC) Draft Safety Evaluation Report (DSER), dated February 2005, in connection with the early site permit (ESP) application submitted by Exelon Generation Company, LLC (Exelon) for the Exelon Generation Company (EGC) ESP site, located about six miles east of Clinton, Illinois.
The purpose of the DSER is to document the results of the staff's review of nuclear safety aspects of Exelon's ESP application, along with any open items resulting from matters that have not been resolved. Because the DSER contains open items, the NRC staff has not yet made a decision regarding whether, from a safety perspective, to recommend to the Commission that an ESP be issued for the EGC ESP site.
After the applicant responds to the open items, the staff will develop the final safety evaluation report (FSER), which is currently scheduled to be issued in August 2005. However, the staff has not, at this time, completed its review of the applicant's new "performance-based" methodology regarding the appropriate seismic ground motion level for the site. The staff informed the applicant in a letter dated November 15, 2004, that review of this new methodology will likely result in a delay in the issuance of the FSER. The staff plans to issue a supplemental DSER, summarizing the results of its technical evaluation of this new methodology, by May 31, 2005. The staff also plans to provide a revised schedule for the FSER in the letter transmitting the supplemental DSER.
The FSER will provide information for the use of the Commission, the Atomic Safety and Licensing Board (ASLB), and the Advisory Committee on Reactor Safeguards (ACRS) in their determinations regarding issuance of an ESP for the EGC ESP site. The Commission's decision on whether to issue an ESP would follow the Commission's review of the FSER and the staff's final environmental impact statement, the findings of the ASLB, and the report of the ACRS.
The NRC will allow 14 days for Exelon to review the DSER for proprietary information. After the 14-day proprietary review waiting period, the DSER (less any proprietary information) will be made publically available in the NRC's Public Document Room (PDR) at 11555 Rockville Pike, Rockville, MD, and on the NRC's ESP web site at http://www.nrc.gov/reactors/new-licensing/esp.html. A copy will also be made available at the Vespasian Warner Public Library.
The document will also be available through the NRC's web-based Agencywide Documents Access and Management System (ADAMS), subject to the agency's restoration of 10 CFR Part 52
documents after review of such documents for sensitive information. The ADAMS accession number for the DSER transmittal letter is ML050400350. The NRC maintains ADAMS, which provides text and image files of NRC's public documents.
