SUMMARY

OF JANUARY 13, 2005, MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION (NRC) AND NUCLEAR ENERGY INSTITUTE (NEI) ON UPDATING THE LICENSE RENEWAL GUIDANCE DOCUMENTS On January 13, 2005, the U.S. Nuclear Regulatory Commission (NRC) staff met with the Nuclear Energy Institute (NEI) and utility representatives at the U.S. Nuclear Regulatory Commission (NRC) Headquarters in Rockville, Maryland. The objective of the meeting was for NEI and NRC staff to discuss the proposed applicability of the draft NUREG-1801 (GALL Report) of January 2005 to utility applications, the use of Table 1 in the application, and to resolve staff comments to NEI 95-10, Revision 4. The meeting was classified as a Category 1 meeting. A listing of meeting participants is provided in Enclosure 1. Following is a summary of the discussions.

NEI Question on the Applicability of Draft GALL Report to July Applications NEI proposed that utilities that applied for license renewal during the interim period before the publication of the approved GALL Report in September 2005 be able to base submittals on the draft GALL Report of January 2005 vice the current GALL Report.

Staff did not object to the use of this option, but stated that it included a risk. Staff plans to review the applications that use the above option against the September 2005 GALL Report. The applicant would be responsible to review the September 2005 GALL Report and to supplement its application as needed, based on the changes between the January 2005 and the September 2005 GALL reports.

NEI Presentation on the Use of Table 1 NEI presented a proposal to eliminate Table 1 from subsequent license renewal applications and to rely only on Table 2. Staff stated that Table 1 provided needed guidance to reviewers and that the removal of this table might result in a more cumbersome review. Thus, the proposal to eliminate Table 1 was not acceptable to the staff. However, staff welcomed the industry to plan for such a submittal on a pilot basis on an application during 2006.

Resolution of Staff Comments to NEI 95-10, Revision 4 NEI presented the industry response to staff comments to NEI 95-10, draft 4. Based on the presentation and subsequent discussion, staff accepted the majority of the industry responses. However, staff took exception to the following items:

The use of an alternative to identifying a seismic anchor or an equivalent anchor that supports the safety-related and nonsafety-related piping interface in the 10 CFR 54.4(a)(2) scoping criteria. Staff stated that this alternative would complicate the application and noted that the applicant would then have to provide a complete justification, for staff approval, of the acceptability for the plant specific application of these alternatives.

The use of exposure duration as a screening criteria. Staff was of the opinion that such usage was not in compliance with 10 CFR Part 54 requirements.

NEI welcomed the option to use the January 2005 GALL Report and the idea of a future pilot application submittal that eliminated Table 1. NEI stated that a clean copy of NEI 95-10 would be made available to staff, but could not satisfy staff concerns of the above two items. Staff stated that it would endorse NEI 95-10, but would take exception to the above-noted items.
