In a letter dated December 17, 2004 (Serial No.04-755), Virginia Electric and Power Company (Dominion) submitted proposed changes to the Surry Power Station Units 1 and 2 Technical Specifications and a request for exemption pursuant to 10 CFR 50.12 and 50.60(b) from the requirements of 10 CFR 50.61 and 10 CFR 50 Appendix G. The purpose of the exemption request was to allow Dominion to revise the Surry reactor vessel material initial properties basis using Topical Report BAW-2308, Revision 1, "Initial RTNDT of Linde 80 Weld Materials," dated August 2003.
During a conference call between the NRC staff and Dominion on January 26, 2005, the NRC stated that although the staff was currently reviewing Topical Report BAW-2308, the report has not been approved for use by the industry at this time. Consequently, Dominion's exemption request cannot be dispositioned by the NRC prior to the completion of the NRC's review and approval of the topical report. Therefore, Dominion hereby withdraws the exemption request to use Topical Report BAW-2308 that'was included in our December 17, 2004 letter. As discussed during the conference call, the NRC's review of the proposed changes to the Surry Technical Specifications will continue. Dominion will re-evaluate the need for the exemption following the completion of the NRC's review and disposition of the topical report.
