SECURITY FREQUENTLY ASKED QUESTIONS PROCESS

Dear Mr. Floyd:

In my letter to you dated July 2, 2004, I indicated that the NRC staff supports the establishment of a security frequently asked questions process (SFAQ), but that our support was contingent upon completing our reviews of all licensees' revised security plans in response to the April 2003 Design Basis Threat Order. As you know, this effort concluded on October 29, 2004.

Subsequently, the NRC staff met with representatives of the industrys Nuclear Security Working Group (NSWG) on November 17, 2004, and on December 8, 2004, to discuss your white paper on the proposed SFAQ process. At the December 8, 2004, meeting, the NRC staff agreed to "pilot" the process using questions that had already been raised by the industry. On January 7, 2005, Mr. Doug Huyck (NRC) and Mr. Jason Remer (NEI) met to discuss planning, preparation, and logistical matters associated with the SFAQ process.

Mr. Huyck has been designated to coordinate with your staff on all matters relating to the SFAQ process. In addition, an NRC technical review panel has been established to support the review and disposition of SFAQs that will be provided by your staff. As of January 18, 2005, we had received four specific SFAQs for consideration.

As was agreed to previously, it is our intention to meet with the NSWG approximately monthly to discuss the technical issues that arise from questions submitted by the industry, exercising the process described in your white paper on a trial basis. The first of these meetings is planned for January 27, 2005. In addition, we circulated your white paper among potentially affected internal NRC stakeholders and produced a series of comments (see attached). We will be prepared to discuss these comments with your staff at the January 27th meeting as well.
