Dear Ms. Imboden,
Our office recieved a letter on Nov. 29, 2004, from Dr. Pao-Tsin Kuo with a Biological Assessment for the Point Beach Nuclear Plant license renewal, and a request for a concurrence of effects determinations on listed species.
Overall, the assessment is well done.
However, at this time we are unable to concur with the determination regarding the piping plover because we need some additional information.
The BA states that WE Energies will conduct an annual census between June 1 and June 15. We recommend that window be expanded to include at least the last full week in May. The BA also does not specify how many surveys will be conducted. We encouraged the applicant to conduct weekly surveys, but if that is impossible, we recommend that one survey be conducted in May (before Memorial Day), and another be conducted at least 7-10 days later in early June. If possible, we would like to receive a copy of WE Energies' Habitat Suitability Assessment for the plover.
Once we receive more specific information on the timing and number of plover surveys which WE Energies has/will commit to conducting, we can respond to the concurrence request.
