Dear Mr. Sheppard:

I am responding to your August 2, 2004, letter in which the STP Nuclear Operating Company (STPNOC) volunteered to be a pilot plant for industry in support of NRCs development of Regulatory Guide (RG) 1.200, An Approach for Determining the Technical Adequacy of PRA Results for Risk-Informed Activities. For the reasons stated below, I am granting a fee waiver for the staffs review of your license amendment request and the supporting technical specification changes in accordance with the applicable provisions of 10 CFR 170.11.

Consistent with the Commissions policy statements on technical specifications (TS) and the use of probabilistic risk assessments (PRA), the staff and industry are developing risk-informed improvements to TS. STPNOC requested a fee waiver for the entire review of the license amendment which includes the broad-scope review of its risk-informed set of TS changes, known as Risk Management Technical Specifications (RMTS) Initiative 4b. STPNOCs proposed application will apply its PRA program to calculate the changes in risk from the actual plant configuration. By comparing the calculated risk to pre-determined risk thresholds, the configuration risk management program will be capable of providing both a technical basis and robust calculation for an acceptable configuration-specific allowed outage time. STPNOC is therefore proposing to be a pilot for the RMTS Initiative 4b effort.

In accordance with 10 CFR 170.11(a)(1)(iii), the NRCs Office of Nuclear Reactor Regulation (NRR) has determined the application will assist in its generic development of regulatory guidance, and that the lessons learned from the pilot application will be documented and reflected in the final regulatory guide. Furthermore, the NRR has determined that this pilot plant submittal supports the NRC's PRA program. Accordingly, I am granting a fee waiver.
