Withdrawal of License Amendment Application to Increase Allowable Power (License Amendment Request No. 00-0006)

Ladies and Gentlemen:

On October 12, 2001, the FirstEnergy Nuclear Operating Company (FENOC) submitted an application for an amendment to the Davis-Besse Nuclear Power Station (DBNPS), Unit Number 1, Operating License Number NPF-3, Appendix A Technical Specifications, regarding a proposed increase in allowable power. The proposed amendment (DBNPS Serial Number 2692) would make the necessary Technical Specification changes to allow an increase in the authorized rated thermal power from 2772 MWt to 2817 MWt (approximately 1.63%), based on the use of Caldon Inc. Leading Edge Flow Meter (LEFM) CheckPlusTM System instrumentation to improve the accuracy of the feedwater mass flow input to the plant power calorimetric measurement. On February 27, 2002 and April 6, 2003, FENOC submitted supplemental information (DBNPS Serial Numbers 2759 and 2815, respectively) regarding the license amendment application.

By letter dated April 29, 2003 (DBNPS Log Number 6085), FENOC was notified that the NRC staff had suspended review of the license amendment application and closed associated TAC No. MB3280. The letter further stated that the NRC would await a letter from FENOC stating that FENOC was ready for the review to recommence.

On September 1, 2003, FENOC submitted a letter (DBNPS Serial Number 2976) notifying the NRC of its plans to review and update the October 12, 2001 license amendment application.

FENOC noted that the need to update the submittal was mainly due to the extensive design basis reviews, revisions to analyses and calculations, and the plant modifications made during the Thirteenth Refueling Outage (13RFO). FENOC further stated that the submittal of the update

Docket Number 50-346 License Number NPF-3 Serial Number 3102 Page 2 would be constrained by resource availability until after restart from the 13RFO, and would include the request for recommencement of NRC review of the license amendment application.

Confirming discussions with the NRC staff on September 23, 2004, FENOC now plans to completely supersede the original license amendment application. Accordingly, FENOC withdraws the October 12, 2001 license amendment application. FENOC currently plans to re-submit the license amendment application in the second quarter of 2006.

Based on the above, commitments associated with the October 12, 2001 license amendment application and its above-referenced supplemental letters that have not already been closed are no longer applicable.
