ADMINISTRATIVE CHANGES TO TECHNICAL SPECIFICATIONS (TAC NO. MC4957)

Dear Mr. Lambert:

The U.S. Nuclear Regulatory Commission has issued the enclosed Amendment No. 180 to Facility Operating License No. DPR-43 for the Kewaunee Nuclear Power Plant. This amendment revises the Technical Specifications in response to your application dated October 14, 2004.

The amendment corrects errors in Technical Specifications 3.10.i and 6.9.a.4.A.

A copy of the Safety Evaluation is also enclosed. The Notice of Issuance will be included in the Commission's next regular biweekly Federal Register notice.

1. The U.S. Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment by Nuclear Management Company, LLC (NMC),

dated October 14, 2004, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and paragraph 2.C.(2) of Facility Operating License No. DPR-43 is hereby amended to read as follows:

(2) Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No.180, are hereby incorporated in the license. The licensees shall operate the facility in accordance with the Technical Specifications.

3. This license amendment is effective as of its date of issuance and shall be implemented within 60 days of the date of issuance.

ATTACHMENT TO LICENSE AMENDMENT NO. 180 FACILITY OPERATING LICENSE NO. DPR-43 DOCKET NO. 50-305 Replace the following pages of the Appendix A Technical Specifications with the attached revised pages. SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATING TO AMENDMENT NO. 180 TO FACILITY OPERATING LICENSE NO. DPR-43 NUCLEAR MANAGEMENT COMPANY, LLC KEWAUNEE NUCLEAR POWER PLANT DOCKET NO. 50-305

1.0 INTRODUCTION

By application to the Nuclear Regulatory Commission (NRC, Commission) dated October 14, 2004, the Nuclear Management Company, LLC (NMC, or the licensee), proposed an amendment to the Technical Specifications (TSs) for Kewaunee Nuclear Power Plant. The proposed changes would correct errors in TSs 3.10.i and 6.9.a.4.A.

Specifically, TS 3.10.i, "Rod Position Deviation Monitor," currently requires that:

If the rod position deviation monitor is inoperable, individual rod positions shall be logged at least once per eight hours after a load change greater than 10 percent of rated power or after greater than 24 steps of control rod motion.

The licensee proposes to add the word "and" after "eight hours" to read:

If the rod position deviation monitor is inoperable, individual rod positions shall be logged at least once per eight hours and after a load change greater than 10 percent of rated power or after greater than 24 steps of control rod motion.

The licensee also proposes to revise TS 6.9.a.4, "Core Operating Limits Report (COLR)," Item A, to reflect the correct numbering of the references to items in TS 3.10.

2.0 EVALUATION Amendment No. 103, dated November 5, 1993, revised TS 3.10.i to change "once per shift" to "once per eight hours." During the revision process, the word "and" was inadvertently omitted between the words "hours" and "after" on the TS page submitted by the licensee with the license amendment application, dated June 22, 1993. The licensee's safety evaluation submitted with the application reflects the correct wording. The licensee also states that the correct logging requirements are reflected in the operating procedure for the plant process computer. Since the proposed change to TS 3.10.i corrects the TS to reflect the intended logging requirements as actually implemented, the proposed change is acceptable to the staff.

Amendment No. 167, dated April 4, 2003, revised TS 3.10 and resulted in the renumbering of items within TS 3.10. Several of the renumbered items are referenced in TS 6.9.a.4.A.

However, the referenced item numbers were not corrected in TS 6.9.a.4.A by Amendment No.

167, due to inadvertent omission from the license amendment application, dated July 26, 2002, as supplemented. Only the numbering of the items in TS 6.9.a.4.A was incorrect; the item titles were stated correctly. Since the proposed changes to TS 6.9.a.4.A correct the numbering of the items referenced in TS 3.10, the proposed changes are acceptable to the staff.

3.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Wisconsin State official was notified of the proposed issuance of the amendment. The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

The amendment changes recordkeeping, reporting, or administrative procedures or requirements. The NRC staff has determined that the amendment involves no significant increase in the amounts and no significant change in the types of any effluents that may be released offsite and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration, and there has been no public comment on such finding (69 FR 70720). Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10)(ii). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

5.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
