OREGON STATE UNIVERSITY AMENDMENT RE: PHYSICAL SECURITY PLAN CHANGES (TAC NO. MC 3297)

Dear Dr. Klein:

The U.S. Nuclear Regulatory Commission (NRC or Commission) has issued the enclosed Amendment No. 19 to Amended Facility Operating License No. R-106 for Oregon State University. The amendment consists of changes to the amended facility operating license in response to your application of May 24, 2004, as supplemented on September 21 and November 23, 2004.

The amendment changes the Physical Security Plan (PSP). Your amendment request was identified as Safeguards Information and as such it, along with the safety evaluation are being withheld from public disclosure pursuant to 10 CFR 73.21.

A copy of the safety evaluation supporting Amendment No. 19 is also enclosed.

OREGON STATE UNIVERSITY DOCKET NO. 50-243 AMENDMENT TO AMENDED FACILITY OPERATING LICENSE Amendment No. 19 License No. R-106

1. The U.S. Nuclear Regulatory Commission (the Commission) has found that A. The application for an amendment to Amended Facility Operating License No. R-106 filed by Oregon State University (the licensee) on May 24, 2004, as supplemented on September 21 and November 23, 2004, conforms to the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the regulations of the Commission as stated in Chapter I of Title 10 of the Code of Federal Regulations (10 CFR);

B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance that (i) the activities authorized by this amendment can be conducted without endangering the health and safety of the public and (ii) such activities will be conducted in compliance with the regulations of the Commission; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; E. This amendment is issued in accordance with the regulations of the Commission as stated in 10 CFR Part 51, and all applicable requirements have been satisfied; and F. Prior notice of this amendment was not required by 10 CFR 2.105 and publication of a notice for this amendment is not required by 10 CFR 2.106.

ENCLOSURE 1 SAFEGUARDS - 1INFORMATION

2. Accordingly, the license is amended by changes to paragraph 2.C.(3) of Amended Facility Operating License No. R-106, which is hereby amended to read as follows:

(3) Physical Security Plan The licensee shall maintain and fully implement all provisions of the Commissions approved physical security plan, including amendments and changes made pursuant to the authority of 10 CFR 50.54(p). The approved security plan consists of documents withheld from public disclosure pursuant to 10 CFR 73.21, entitled Oregon State University TRIGA Reactor Physical Security Plan, submitted by letters dated September 14, 1974, October 24, 1974, June 26, 1975, March 19, 1976, June 10, 1976, February 4, 1977, October 18, 1979, January 15, 1980, September 19, 1980, November 26, 1980, December 22, 1980, June 21, 1999, and May 24, September 21 and November 23, 2004.

3. This license amendment is effective as of the date of its issuance.
