CALLAWAY PLANT, UNIT 1 - WITHDRAWAL OF LICENSE AMENDMENT REQUEST TO REVISE TECHNICAL SPECIFICATIONS 3.9.2 AND 3.3.9 (TAC NO. MC1575)

Dear Mr. Randolph:

By letter dated December 15, 2003 (ULNRC-04883), Union Electric Company requested revisions to Technical Specifications (TSs) 3.9.2, "Unborated Water Source Isolation Valves,"

and 3.3.9, "Boron Dilution Mitigation System (BDMS)" for the Callaway Plant, Unit 1. The revisions were to address inadvertent boron dilution events in Mode 6 and to make TS 3.3.9 consistent with TS 3.9.2. Several e-mails and teleconferences were held between your staff and the NRC staff since December 15, 2003, to discuss the proposed license amendment request (LAR).

By letter dated October 29, 2004 (ULNRC-05069), Union Electric Company withdrew the December 15, 2003, LAR. The letter stated that administrative controls would address the potential boron dilution sources in Mode 6 and that a revised LAR would be submitted once a modified approach was developed.

Based on the letter of October 29, 2004, the NRC staff has closed out its review of the LAR and TAC No. MC1575 is closed. The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

7590-01-P UNITED STATES NUCLEAR REGULATORY COMMISSION UNION ELECTRIC COMPANY DOCKET NO. 50-483 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of Union Electric Company (the licensee) to withdraw its December 15, 2003, application for proposed amendment to Facility Operating License No. NPF-30 for the Callaway Plant, Unit No. 1, located in Callaway County, Missouri.

The proposed amendment would have revised Technical Specifications (TSs) 3.3.9, "Boron Dilution Mitigation System (BDMS)," and 3.9.2, "Unborated Water Source Isolation Valves." The proposed changes would replace the phrase "unborated water" by the word "dilution" in several places and delete references to isolation valves BGV0178 and BGV0601. A Note would also be added to TS 3.9.2 about dilution source path valves may be unisolated.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on February 3, 2004 (69 FR 5211).

However, by letter dated October 29, 2004, the licensee withdrew the proposed change.

For further details with respect to this action, see the licensee's application for amendment dated December 15, 2003, and the licensee's letter dated October 29, 2004, which withdrew the application for a license amendment.
