Nuclear Regulatory Commission Attention: Document Control Desk Washington, DC 20555 Haddam Neck-Plant Defueled Physical Security Plan Request for Withdrawal of Security Orders Pursuant to 10CFR50.54(p) and 10CFR50.4(b)(4) Connecticut Yankee Atomic Power Company (CYAPCO) is informing the Nuclear Regulatory Commission (NRC) of a future change to the Security Plan for the Haddam Neck Plant (HNP). All spent fuel is expected to:be transferred to the Independent Spent Fuel Storage Installation (ISFSI) by February 2005.' Followin'g thtEitran'sfer of all'spent fuel; CYAPCO'will be revising'h'e Security Plan requiremen'its to eliminate the security eq'ir are associated with The Spent Fuel 'Building Protected Area.' The security plan requirmen'ts that are associated with the ISFSI Protected Area'will remain and will be unaffected by the change.

CYAPCO, therefore, requests that the Security Orders 1) t2)applicable to decommissioned plants with spent fuel in the spent fuel pool be withdrawn once all spent fuel has been removed from the pool and transferred to the ISFSI. Our response(3)(4)(5) to these Orders will no longer be applicable and associated

-commitments will no longer be implemented since the spent fuel pool will be empty.

U. S. Nuclear Regulatory Commission CY-04-176 / Page 2 2005 in preparation to decommission the building. CYAPCO understands that upon termination of the Orders and revision of the security plan, the spent fuel pool will no longer be an authorized storage location for spent fuel.

Compliance with the Security Orders(6)(7) applicable to plants with spent fuel stored in an ISFSI will continue as will compliance with our responses(8)(9)(10)(11) to the ISFSI related Orders.

An evaluation of this change in accordance with 10CFR50.54(p) has determined that it does not reduce that safeguards effectiveness of the plan and, as a whole, the plan continues to meet the standards of 10CFR73.55 as applicable.

In conclusion, CYAPCO hereby requests NRC to rescind the NRC security orders for decommissioned plants contingent upon transfer-of-all fuel to-the-ISFSI. Transfer of spent fuel assemblies is expected to be complete by February 2005. CYAPCO plans to implement the security plan changes within 60 days after transfer of the last spent fuel assembly from the spent fuel pool to the ISFSI.
