Before the Licensing Board is the October 5, 2004 request of the New England Coalition (NEC) for an extension of time until October 11, 2004, to file its 10 C.F.R. § 2.309(h)(2) reply to the September 29, 2004 answers of applicants Entergy Nuclear Vermont Yankee, L.L.C. and Entergy Nuclear Operations, Inc. (Entergy) and the NRC staff to NECs August 30, 2004 request for hearing. In its request, NEC represents that Entergy, the Vermont Department of Public Service (VDPS), and the NRC staff do not oppose the extension. Also pending before the Board is a similar request by VDPS for a one-day extension within which to file their own reply to the answers of Entergy and the NRC staff to VDPSs August 30, 2004 petition to intervene. As is the case with the request of NEC, none of the participants raise any objection.
- Copies of this order were sent this date by Internet e-mail transmission to counsel for (1) licensees Entergy Nuclear Vermont Yankee L.L.C. and Entergy Nuclear Operations, Inc.; (2) petitioners Vermont Department of Public Service and New England Coalition of Brattleboro, Vermont; and (3) the staff.
Upon consideration of these requests and the agreement among the participants, it is ORDERED, that both requests for an extension of time are granted in that NEC shall have up to and including Monday, October 11, 2004, and that VDPS shall have up to and including Thursday, October 7, 2004, within which to file any replies to the responses of the applicant and the staff.
