Rubenstein United States Nuclear Regulatory Commission Washington, DC 20555-0001 NEW ENGLAND COALITION'S REQUEST FOR SCHEDULE ADJUSTMENT Gentlemen, Having been advised by Chairman Karlin's office that this Panel is contemplating scheduling oral arguments on contentions during the business week of October 18 through 21, New England Coalition immediately set about determining the availability of its team for that time.

We found that the first three days of that week are extremely problematic for us in terms of previously set and conflicting schedules.

We then polled the other parties as to their availability and willingness to accommodate a proposed alternate schedule of either: October 21 and 22; or during the following week beginning with October 25.

NRC staff responded that they had no objection to any of the suggested dates. The State of Vermont stated that their team is available for any of the suggested dates, save for Friday, October 29. Entergy answered that they had no objection to scheduling for October 21 and 22, but that they would rather not put off the oral argument until the following week.

New England Coalition now respectfully requests, in consideration of the facts stated above, that this Panel schedule oral argument on the contentions for October 21 and 22, 2004. Or if Entergy, with more time to consider, finds that it can accommodate a change
