Dear Dr. Diaz:

I write to request an immediate update in regard to several concerns about the Tndian Point Energy Center.

I am extremely concerned that the plant's security force may go on strike if no agreement can be reached with Entergy by midnight on October 2, 2004. If a strike occurs, a replacement security team will be employed at Indian Point, and it is essential that the Nuclear Regulatory Commission (NRC) and Entergy be prepared to provide strong and seamless security for the plant. I understand that you have approved Entergy's stnke contingency plan, but I believe that there are outstanding questions about the size of the replacement force, the adequacy of their training, and the length of the shifts that they will be asked to work. Please provide my office with a detailed update on these specific issues and the contingency plan as a whole as soon as possible.

In addition, I remain concerned about the NRC's oversight of Entergy's maintenance efforts at Tndian Point. Last Friday, there was an unplanned shutdown at Tndian Point 2 because of a valve failure, the third interruption of service due to valve problems at Indian Point 2 in September. These events echo concerns that I raised with you in January of this year, after the release of an NRC Special Inspection Report which revealed that problems with backup generators at Indian Point went uncorrected for months, and even years, after being identified by the NRC. Safe operation at Indian Point is crucial to my constituents, and I want to be sure that the NRC is acting to identify and require prompt correction of equipment problems at the plant.

Please provide my office, no later than October 8, 2004, with a list of outstanding maintenance problems at Indian Point and the NRC's timeline for requiring corrective action.
