EMERGENCY PLAN CHANGES FOR THE OREGON STATE UNIVERSITY TRIGA REACTOR (TAC NO. MC4282)

Dear Dr. Klein:

This letter acknowledges receipt of your letter dated September 2, 2004, which transmitted changes to the Oregon State University TRIGA Reactor Emergency Response Plan submitted under the provisions of 10 CFR 50.54(q). In the letter, you stated that the changes would result in a reduction of the effectiveness of the plan.

You proposed to change monthly, quarterly and semi-annual inspection and inventories to an annual basis and initiate a quarterly check of applied security seals. The intent being that once inspected and inventoried, as long as the security seal remains intact no additional action would be required until the next annual inspection and inventory. Ten years of experience has shown that the equipment remains unchanged from inventory to inventory.

The regulatory requirements found in Section IV. G. of Appendix E to 10 CFR 50 call for the description in the emergency plan of provisions to ensure emergency equipment and supplies are maintained up to date. The guidance in NUREG-0849, Standard Review Plan for the Review and Evaluation of Emergency Plans for Research and Test Reactors, Section 10.4.c, indicates that a minimum frequency of inventory for equipment and supplies be specified.

The proposed change in frequency from monthly, quarterly and semi-annual inspection and inventories to an annual basis with the initiation of a quarterly check of applied security seals is acceptable. Though the frequency of actual inspection and inventory is less often than previously provided, it still allows for a periodic check of equipment to ensure availability in the event of an emergency. The addition of quarterly verification of security seals continues the confirmation on a quarterly basis that the equipment and supplies are available. Our review of these changes indicates that they are in accordance with 10 CFR 50.54(q) and do not decrease the effectiveness of the emergency plan and the plan as changed continues to meet the requirements of Appendix E to 10 CFR 50. Therefore, the proposed amendments to the emergency plan are acceptable.
