Dear Mr. Brodsky:
This is to acknowledge your telephone discussion with Mr. Brian Holian of this office on September 17, 2004, and to respond on behalf of the Nuclear Regulatory Commission (NRC) to your letter of September 15, 2004, regarding the conversation between Mr. Richard Berkley of your staff, and Mr. Christopher Long of NRC's Region I office. We had called your office on September 14 to ensure that you were aware that Indian Point Energy Center's security force contract is due to expire on October 2, 2004, and that contingency plans are being implemented to provide for facility security in the event of a labor action, such as a strike.
I want to assure you that NRC is closely monitoring Entergy's security contingency plans and preparations to confirm that the physical protection and security of the Indian Point facility are maintained. The licensee is required to establish, implement, and maintain the physical protection and security program in conformance with NRC requirements at all times. The posts and positions will be staffed by experienced management personnel, and supplemented by replacement security personnel who must meet the same standards, including training and qualification, as the officers they may replace. NRC will closely monitor developments and conditions at Indian Point to ensure that the physical protection and security program continues to be implemented and maintained in accordance with all applicable regulatory requirements.
