On August 18, 2004, the Nuclear Regulatory Commission issued Order EA-03-097 (Reference a) modifying our Independent Spent Fuel Storage Installation (ISFSI) license, requiring compliance with the specified additional security measures. Pursuant to the requirements in Section III of Order EA-03-097 and in accordance with 10 CFR 72.4, Calvert Cliffs Nuclear Power Plant, Inc. (Calvert Cliffs), hereby submits its Response. This letter does not contain any Safeguards Information as defined in 10 CFR 73.2.

In Reference (b) we reported full compliance with the requirements described in Attachment 2 to Order EA-02-261 (Reference c) and informed you that the requirements were completed within the dates specified in Section III, Condition A of that Order. The Calvert Cliffs' ISFSI is located at the same site as the operating power reactors. Therefore, as allowed by Order EA-03-097, the compensatory measures for access authorization for operating power reactors issued in Order EA-02-261, implemented at Calvert Cliffs, provide an alternate means of complying with Order EA-03-097.

Inasmuch as we are exercising the option to implement the compensatory measures for access authorization issued in Order EA-02-261 as an alternative means of complying with Order EA-03-097, the requirement to submit a schedule for achieving compliance with each requirement described in Attachment I to Order EA-03-097 (Section III, Condition C.1) is satisfied by this response. Furthermore, full compliance with the requirements described in Attachment 1 of Order EA-03-097 is achieved by

Document Control Desk September 7,2004 Page 2 exercising this option, therefore, Order EA-03-097 Section III Condition C.2 is also satisfied by this response.

Pursuant to the requirements of 10 CFR 2.202(a)(2), a document relating to the Answer to the Order is being transmitted to the Secretary of the Commission under separate cover.
