Chemical Application Specifications Mike - attached are the 2 docs I believe you are referring to, as well as another 7-page guideline our Forestry Dept has used. The compilation of the Forestry Dept's ROW maintenance practices I have been told is on the FERC website.

Also - for the barking tree frog - it is listed in Surry's FEIS NUREG-1 437 Supplement 6 on pages 2-24 and 2-25.

wDominion- SPECIFICATIONS CHEMICAL CONTROL OF BRUSH ON RIGHTS -OF -WAY [FOLIAR APPLICATION]

1. The contractor shall furnish all equipment, labor, and supervision required to eliminate all undersirable vegetation within the boundaries of the right-of-way as defined by the sketch and maps attached to the Scope of Work.

2. Foliar spraying shall be in accordance with the specifications hereinafter set forth and shall be done during the growing season from the time of full leaf development in the spring of 2004 until late summer when plant activity begins to decline.

3. Unless mutally agreed, the contractor shall apply a mixture of 4% Krenite, 1/2%

Arsenal, 1/4% Nufilm, and 1/41% Timberland 90 in water to undesirable foliage on dry ground with Escort added acording to label instructions when locust and other resistant species are encountered. A mixture containing 2% Accord, 114% Nufilm, and 1/4% Timberland 90 in water shall be used when direct application to surface water is nessesary.

4. The herbicide mixture shall be applied to all living foliage of brush species within the full width of all rights-of-way specified in the Scope of Work with the following exceptions: (1) areas where spraying is prohibited by property owners; (2) areas where natural or planted screens have been established for vista screening purposes; (3) areas in lakes, ponds, streams, and on ditch banks; (4) areas around the home, recreations areas, historical areas, and similar sites.

5. Vines and viney growth are considered undesirable vegetation when they are growing within three feet of a transmission structure base including concrete footings and the groundlines of wood poles and direct buried light duty steel poles. Such growth is to be treated with the mixture described in paragraph #3 above. In addition, the soil within 3 feet of any transmission structure base, 360 degrees around every base, shall be treated with 5% Granular Arsenal at the label rate.

6. At the Contractor's discresion, undesirable brush on the right of way in fence rows and other areas that are particularly sencitive to drift may be basally treated with a chemical mix to be approved by the Company. Otherwise this brush must be sprayed.

7. Desirable vegetation which will provide ground cover, such as honeysuckle, huckleberry, laurel, dogwood, redbud, holly, mountain laurel, rhododendron, wax myrtle, etc., shall not be sprayed deliberately.

8. Payment for this work will be on a lump sum basis as described in the Terms and Conditions with 90% of the agreed sum to be paid when the initial application is completed to the satisfaction of the Company. The remaining 10% will be paid during the growing season of 2005, after the contractor has completed a follow-up appication to control any surviving undesirable vegetation on the right of way.

9. Herbicides, adjuvents, surfactants and other chemicals to be used in the initial application shall be supplied by Dominion through UAP Timberland. The costs for these materials as outlined in the attached price list will be deducted from the initial application payment.

10. The contractor shall provide personnel who are familiar with vegatation control work and certified to apply herbicides to right-of-way in the jurisdiction. The forman shall be familiar with the woody plants and herbaceous perennials commonly found on the right-of-way and with the Company's method of numbering and locating structures on maps.

11. The contractor agrees to progress at an orderly and reasonable manner. Portions of the right-of-way that have been sprayed less than one (1) hour prior to a heavy rain, shall be resprayed. Spraying may be resumed after a heavy rain when foliage is sufficiently dry to retain the spray mixture.

12. The contractor shall use equipment that is adequate for effective chemical application and shall keep this equipment in satisfactory operating condition. The Company representative may require the removal from the job any faulty equipment until the faulty condition is corrected and the equipment is able to function effectively. This may also require the removal of the crew until such condition is corrected. All application equipment shall be properly equipped to depense the proper amount of material. All mixing, storage, or holding tanks, whether on application or equipment, shall be leakproof. All spray distribution systems shall be leakproof, and any pumps which such systems may have shall be capable of operating at sufficient pressure to assure a uniform and adequate rate of discharge. All application equipment shall be equipped with whatever cut-off valves and discharge orifices necessary to enable the operator to pass over non target areas without contaminating them. Equipment shall comply with all local, state, and federal safety standards.

13. Chemicals shall not be applied during periods of high or unfavorable wind when chance of drift damage any be increased. Chemicals shall not be applied to wild cherry growing in a pasture field, or in an area where cattle might have an opportunity to eat the leaves. Empty chemical drums shall be removed from the work area. Contractor shall not handle, transport, store, display, or distribute Page 2 of 3

Contractor shall not dipose, discard or store any chemicals or chemical containers in such a manner as may cause injury to humans, vegetation, crops, livestock, wildlife, pollinating insects or to pollute any water supply or waterway.Contractor shall comply with all local, state, and federal pesticide laws.

14. Winch lines shall not be attached to towers or other overhead structures. Spray solutions shall not be discharged into any stream when filling or cleaning out spray equipment.

15. The Company inspector or his desgnee shall be responsible for making general quality field checks and to direct the contractor to take corrective action when required. The contractor shall supply the Company with sample spray mixture when requested.

2. Basal herbicide application shall be in accordance with the specifications hereinafter set forth and the initial application shall be completed before December 15,2004.

3. Unless mutally agreed, the contractor shall apply a mixture of 20% BK-800, 10%

Garlon 4, and 70% Bark Oil EC by hand spray gun or backpack sprayer in order to thoroughly wet the basal parts of brush on all sides to a height of 12 to 15 inches from the ground.

4.
