As you may have read in the newspapers, the Vermont Public Service Board, which is hearing our uprate case, recently expressed concern about Vermont Yankee's thoroughness and timeliness in forwarding documents to the New England Coalition for their use in preparing their case against the uprate. While we remain optimistic on the merits of the uprate and its benefits to the state of Vermont, the issue of the adequacy of the so-called discovery portion of the case must be addressed.

This afternoon, Entergy Nuclear Site Vice President Jay Thayer submitted a letter to the Public Service Board detailing our improved discovery process for going forward with the case.

Dear Chairman Dworkin,

I am writing to you in regard to Entergy Nuclear Vermont Yankee's above-referenced petition before the Vermont Public Service Board to modify the VY Station to increase the electricity generation by 20%.

I understand that at last Wednesday's hearing, the Board expressed grave concerns regarding Entergy VY's compliance with Board Orders requiring the production of documents and other information to the New England Coalition. I also know that the Board has asked NEC to file a proposal to address discovery issues, both in terms of monetary compensation for lost time and effort and in terms of schedule adjustments to allow for fill review of additional documents which have been provided. Entergy VY will review NEC's filing, and will respond, as required, on September 29.

I personally want to assure the Board that all ofus at Vermont Yankee understand that the Board's process must be fair, open and comprehensive. We also understand that it is our obligation to provide information requested by the parties to this case.

To assure that the Board's expectations as to discovery are met and that its orders are followed, I have instructed the power uprate team to perform a review of the process used in identifying documents to be made available during the discovery process,

Mr. Michael Dworkin September 23, 2003 Page 2 including identification of documents to be withheld based on a claim of confidentiality or privilege. In addition, we will ensure that any documents identified during this process which have not previously been provided are immediately forwarded to the NEC as well as the DPS. We will also prepare an index of all documents provided, and we will update privilege logs and logs of GE or Stone & Webster proprietary information. I expect that the documents and indices will be sent out as of 9/29/03. I have also spoken directly with our power uprate legal team and have been assured that steps have been taken with respect to our documentation identification and production process to address the Board's concerns.

I want to assure the Board that it has always been our intent to be responsive to the Board's and NEC's inquiries into'the merits of our power uprate proposal. We continue to believe that power uprate meets the criteria of Section 248 and that it will provide a benefit to the citizens of the State of Vermont. I sincerely regret that discovery difficulties have interfered with the ability of the parties to review the proposal and present their viewpoints. I believe that the review described above will result in the fill disclosure of all documents relevant to power uprate. I am prepared to take additional management actions should they prove necessary to ensure Entergy fully meets the Board's expectations in these proceedings.
