Dear Mr. Mulligan:

Your petition dated June 17, 2004, has been referred to the Office of Nuclear Reactor Regulation pursuant to 10 CFR 2.206 of the Commissions regulations. You requested that the Nuclear Regulatory Commission (NRC) ask for the resignation of Entergy CEO Gary J. Taylor, or for the shutdown of all of Entergys nuclear power plants. As the basis for your request, you state that Mr. Taylor used an inaccurate push poll which could instill a poor corporate safety culture at Vermont Yankee.

Our Petition Review Board (PRB) has reviewed your submittal. The staff has concluded that your submittal does not meet the criteria for consideration under 2.206 because it does not provide information to support the assertion that a poor safety culture exists at Vermont Yankee. We contacted you via email on June 30, 2004, and provided you an opportunity to address the PRB and present additional information or clarify your concerns. You chose not to address the board. Because your submittal alleges wrongdoing on the part of an NRC licensee, we have decided to treat your concern as an allegation. Our allegations staff will contact you separately to obtain additional information regarding this issue.
