SURRY POWER STATION: NUCLEAR REGULATORY COMMISSION OFFICE OF INVESTIGATIONS CASE NUMBER 2-2003-075

Dear Mr. Christian:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)

Office of Investigations (OI) completed investigation regarding a contract rigger who entered the Radiologically Controlled Area (RCA) prior to passing the prerequisite basic radiation worker (BRW) training. The investigation also reviewed whether Surry Power Station (SPS) management or the contractors management deliberately circumvented procedures to allow the rigger to enter and continue to work within the RCA, with prior knowledge that the contractor had not completed the BRW training.

Based on the results of the investigation, the NRC has identified a non-cited violation involving Technical Specification 6.4.B and the failure to follow SPS Procedure VPAP-2101, Radiation Protection Program. The violation occurred from September to October, 2003, and involved a contractor who: was allowed to gain unescorted access to the RCA without an Access Authorization to the RCA for a Visitor/ Non-Radiation Worker, was allowed to enter High Radiation areas and contaminated areas without authorization by the Manager, Radiation Protection, and Site Vice President, and was allowed to perform physical work in the RCA without completing the prerequisite BRW training. Furthermore, the foremen for whom the individual worked did not ensure that the worker was qualified.

OI did not substantiate that SPS management or the contractors management deliberately allowed or circumvented procedures to permit this activity.

For administrative purposes, this non-cited violation will be documented in an upcoming integrated inspection report. If you contest this non-cited violation, you should provide a response within 30 days of the date of the upcoming inspection report, as described therein.

SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region II, on November 14, 2003, to determine if a former Fluor Global Corporation (FGC) contract rigger at the Virginia Electric and Power Company (Dominion) Surry Power Station (SPS) deliberately entered the Radiologically Controlled Area (RCA) knowing that he, on two occasions, had not passed the prerequisite basic radiation worker (BRW) training. Also at issue was whether either SPS and/or FGC management possessed prior knowledge of the riggers BRW training failures, and despite that knowledge, deliberately allowed, or circumvented procedures to allow the rigger to enter and continue to work within the RCA.

Based on the evidence developed during this investigation, the allegation that a contract rigger deliberately failed to follow procedures associated with nuclear employee training and radiation work permit requirements was substantiated. The allegation that FGC and SPS personnel deliberately allowed, or circumvented procedures to allow the rigger to enter and continue to work within the SPS RCA was not substantiated.
