QUAD CITIES NUCLEAR POWER STATION, UNITS 1 AND 2 - WITHDRAWAL OF EXEMPTION REQUEST (TAC NOS. MC1371 AND MC1372)
Dear Mr. Matthews:
By letter dated November 21, 2003, you requested an exemption from Title 10 of the Code of Federal Regulations (10 CFR) Section 50.75(h)(2). This exemption would have allowed MidAmerica Energy Company (MEC) to meet the requirements of 10 CFR 50.75(h)(2), which became effective on December 24, 2003, at a later date because a ruling from the Illinois Commerce Commission (ICC) was required to meet the regulations. MEC submitted the exemption request because it was unsure if a ruling from the ICC would be granted prior to the effective date of 10 CFR 50.75(h)(2). However, by letter dated December 18, 2003, you withdrew the exemption request because the ICC had issued the required Order on December 17, 2003.
While considering issuance of the requested exemption, the Nuclear Regulatory Commission staff published in the Federal Register (68 FR 70843, December 18, 2003, and 68 FR 71173, December 22, 2003) an environmental assessment and finding of no significant impact as required by 10 CFR 51.21. Since the exemption request has been withdrawn, the environmental assessment and finding of no significant impact is no longer applicable and is being withdrawn. Therefore, the Commission has filed the enclosed Notice of Withdrawal of Environmental Assessment with the Office of the Federal Register for publication.

AND MIDAMERICAN ENERGY COMPANY DOCKET NOS. 50-254 AND 50-265 QUAD CITIES NUCLEAR POWER STATION, UNITS 1 AND 2 NOTICE OF WITHDRAWAL OF ENVIRONMENTAL ASSESSMENT The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of MidAmerican Energy Company (the licensee) to withdraw its November 21, 2003, application for exemption for the Quad Cities Nuclear Power Station, Units 1 and 2, located in Rock Island County, Illinois.
The proposed exemption would have allowed the licensee to delay meeting the requirements of 10 CFR 50.75(h)(2) past the effective date of December 24, 2003.
The Commission had previously issued an Environmental Assessment and Finding of No Significant Impact published in the FEDERAL REGISTER on December 19, 2003 (68 FR 70843), and December 22, 2003 (68 FR 71173), for the proposed exemption as required by 10 CFR 51.21. However, by letter dated December 18, 2003, the licensee withdrew the proposed change. Therefore, the Commission is withdrawing its previously issued Environmental Assessment and Finding of No Significant Impact.
For further details with respect to this action, see the request for exemption dated November 21, 2003, and the licensees letter dated December 18, 2003, which withdrew the request for exemption.
