Dear Mr. Maricque,

The Nuclear Regulatory Commission (NRC) received your e-mail dated Monday, June 14, 2004, in which you seek to intervene and request a hearing in response to NRCs Federal Register notice of the opportunity for a hearing on Nuclear Management Companys request for a 20-year license renewal for the Point Beach nuclear facility. See 69 Fed Reg. 19559 (April 13, 2004).

Your request for a hearing fails to comply with the Commissions regulations. It does not meet the formal requirements for documents set forth at 10 C.F.R. §2.304, and it is now apparent that an original signed document and two copies have not been mailed within two days in compliance with subsection (f) of that regulations requirement for e-mails not in original compliance. In addition, your request does not address the requirements of 10 C.F.R.

§2.309(a) and (d) which require you, as a potential intervenor, to specify the contentions which you seek to have litigated and to set forth how you meet the standing requirements.

Because your e-mail could be read to suggest that you had sent to counsel for all other parties copies of a petition other than the e-mail received by us, we have contacted them and ascertained that they received nothing more than the brief document we received.

In light of the deficiencies in the request you have submitted, I regret to inform you that pursuant to 10 C.F.R. 2.304(g), I am returning your request and refusing it as not acceptable for docketing in an adjudicatory hearing docket on the Point Beach license renewal application.

Opportunity to Request a Hearing Mitchell "Mickey" J. Maricque P.O. Box 825 Green Bay, WI. 54305 Hello:

I am writing to partake in the opportunity to request public hearings on the matter of the application for a 20 year license renewal for Point Beach Nuclear. I will take this opportunity to state that I believe my interests would be adversely affected by the license renewal, and I will state that I would like to participate as a party to the hearing.

I do not believe that the operator, Nuclear Management Company, will be able to adequately operate Point Beach Nuclear, and I do not believe that Point Beach Nuclear will function adequately under the ownership of WE Energy. Considering Point Beachs extremely poor operational history, and its brush with disaster May 28, 1996, no argument could convince me that Point Beach Nuclear will be able to operate without substantial problems and shortcomings with regards to substantial safety considerations.

Copies of my petition were sent to all other parties requested by the United States Nuclear Regulatory Commission.
