Dear Ms Sidebotham:
I am responding on behalf of the Nuclear Regulatory Commission (NRC) to a request from several attendees at a meeting held by the NRC at the Vernon Elementary School in Vernon, Vermont, on March 31, 2004. The request was for the NRC to perform an independent engineering assessment at the Vermont Yankee Nuclear Power Station and that the independent inspection be in compliance with the Vermont State Senate Resolution S.R. 21.
The Vermont Senate forwarded its resolution to the NRC in a letter dated March 17, 2004.
The NRC has taken a closer look at our proposed inspections and technical reviews to assure ourselves that they will identify any potential concerns for operating at uprated power conditions. The NRC has decided to conduct a detailed engineering inspection to supplement our review of Vermont Yankees uprate request. The staff reviewed the Senate request and determined that the specific actions requested by the Senate are satisfied in one way or another through current or planned NRC processes. The NRC responded to the Vermont Senate by letter dated May 24, 2004. In addition, the NRC met with the Vermont Public Service Board on June 28, 2004, to describe in more detail our power uprate review process and planned engineering inspection. We concluded that the detailed technical review, coupled with our program of power uprate and engineering inspections, will provide the information necessary for the NRC staff to make a decision on the safety of Vermont Yankee under uprated power conditions as we consider whether or not we should approve this uprate request. NRC will not approve the power uprate unless we determine that it is safe.
We have established a website that provides current information about our oversight of Vermont Yankee, including the NRCs response to the Vermont State Senate Resolution, at www.nrc.gov/reactors/plant-specific-items/vermont-yankee-issues.html. I believe that the information available on the website will assist in addressing concerns regarding the safety of Vermont Yankee. I have sent copies of this letter to each person who signed the request and provided a mailing address.
