This letter and its enclosures provide TVA's reply to the subject NOV. The NOV contains virtually identical violations for SQN and WBN as documented in your letters to Mr. John A. Scalice, dated May 12, 2004, citing inadequate evaluations. Enclosure 1 to this letter contains TVA's reply to the subject NOV in accordance with 10 CFR 2.201. TVA respectfully disagrees with NRC's characterization of the noncompliances as cited violations. Enclosure 2 explains the bases for TVA's disagreement.

During our review of the NRC inspection reports, TVA discovered an error in the SQN report. In the discussion of closure of the Unresolved Items (URIs), NRC references report 05000327-006/328-006 as containing the original documentation of the URIs.

The correct inspection report for SQN was 05000327-007/328-007.

Enclosure 1 to this response contains "Safeguards Information" as defined in 10 CFR 73.21. TVA therefore requests that Enclosure 1 be withheld from public disclosure.
