Nuclear Liability Insurance for R.E. Ginna Nuclear Power Plant, LLC
Dear Mr. Dinitz:
Please accept this letter as confirmation that American Nuclear Insurers will write nuclear liability insurance for R.E. Ginna Nuclear Power Plant, LLC covering the Robert Emmet Ginna Nuclear Power Station Unit: No.1 situated at 2646 Lake Road, Ontario, New York.
The insurance will be effective coincident with the transfer of ownership of the plant from Rochester Gas & Electric Corporation to Constellation Generation Group, LLC. This insurance is being purchased to satisfy the requirements for primary and secondary financial protection as set forth in Section 1 70b. of the Atomic Energy Act of 1954, as amended.
Effective on the closing date of the transaction, the insurance policy and certificates issued by Nuclear Energy Liability Insurance Association (NELIA) which are currently in effect for Rochester Gas & Electric Corporation will be amended as follows:
Facility Form Policy No. NF-0170 - the Named Insured and the Operator of the Facility will be amended to: R.E. Ginna Nuclear Power Plant, LLC.
Certificate No. NW-0561 to the Master Worker Policy (Facility Worker Form) - the Named Insured and the Operator of the Facility will be amended to:

Mr. Ira P. Dinitz, Indemnity Specialist May 12, 2004 Page 2 Certificate No. N-0014 to the Secondary Financial Protection (SPF) Master Policy - the Named Insured will be amended to R.E. Ginna Nuclear Power Plant, LLC. Also, R.E.
Ginna Nuclear Power Plant, LLC will be added to the Bond For Payment of Retrospective Premiums.
The commitment to write insurance for R.E. Ginna Nuclear Power Plant, LLC covering the Robert Emmet Ginna Nuclear Power Station Unit 1 remains valid through December 31, 2004.
In the event the closing of the sale occurs after this date, we will review the circumstances existing at the time prior to reinstating our commitment to provide insurance.
