Dear Mr. Dacimo:

On April 21, 2003, the Region I Field Office of the NRC Office of Investigations (OI) initiated an investigation (Case No. 1-2003-026) to determine whether: 1) a former Indian Point 2 (IP2) security officer was in possession of a fraudulent Indian Point Entergy Center (IPEC) identification badge that identified him as an NRC employee; 2) another IPEC employee had inappropriately produced a fraudulent identification badge for the former security officer; and 3) the former security officer was using the identification badge in a fraudulent manner.

Although certain individuals provided testimony that the former security officer showed them an identification with the letters NRC on it, there was insufficient evidence to conclude that the former security officer actually possessed such an identification. Also, testimony obtained from IPEC employees indicated that it is highly improbable that such an identification was produced at IPEC. That assessment was based on their knowledge of the capabilities of the IPEC computers used to produce IPEC identification badges, and the security measures in place, coupled with the fact that IPEC has not had any history of unauthorized badges being produced. Therefore, insufficient evidence existed to conclude that an IPEC employee produced or provided the former security officer with a fraudulent IPEC identification badge, identifying him as an NRC employee.
