Dear Mr. Kulik:
I am responding on behalf of the Nuclear Regulatory Commission (NRC) to your letter dated March 31, 2004. In this letter, you expressed your concerns regarding the power uprate request at the Vermont Yankee Nuclear Power Station (Vermont Yankee) and stated your support for the resolution adopted by the Vermont State Senate. The Vermont Senate Resolution requests that the NRC condition approval of any power uprate at Vermont Yankee upon performance of an independent engineering assessment and identifies five specific actions that the Senate requested be included in an independent engineering assessment.
The NRC replied to the request for an independent engineering assessment in its response to the Vermont Public Service Board on May 4, 2004. A copy of this letter was forwarded to you on May 21, 2004. The five specific actions that were included in the resolution of the Vermont State Senate have been carefully considered by the NRC. We have concluded that the specific actions requested by the Senate are already satisfied in one way or another through current or planned NRC processes. The NRC responded to the Vermont Senate by letter dated May 24, 2004. A copy of this letter is attached for your information.
