Dear Mr. Bakken:
As a result of concerns that (1) an engineering supervisor was terminated (discriminated against) for raising safety issues; and (2) licensee supervisory personnel willfully violated technical specifications by directing personnel to exceed work hour limitations, the Nuclear Regulatory Commission (NRC) recently conducted an investigation regarding these matters.
The NRC has completed its investigation into these matters. Based on the results of its investigation, the NRC did not substantiate that (1) an engineering supervisor was discriminated against for raising safety issues; and (2) licensee supervisory personnel willfully violated technical specifications by directing personnel to exceed work hour limitations. A copy of the Region III Office of Investigations report synopsis is enclosed. This concludes the NRCs investigation into this matter.

SYNOPSIS This investigation was initiated on November 5, 2001, by the U.S. Nuclear Regulatory Commission, Office of Investigations (OI), Region III, to determine if a former engineer at the D.C. Cook Nuclear Power Plant was discriminated against for raising safety concerns. On February 19, 2002, OI was asked to concurrently investigate whether licensee supervisory personnel willfully violated technical specifications by directing personnel to exceed work hour limitations.
Based upon the evidence developed, this investigation did not substantiate that a former engineer was discriminated against for raising safety concerns.
