Dear Mr. Crane:
The Region I Field Office of NRC Office of Investigations (OI) initiated an investigation (OI Case 1-2003-018) on February 21, 2003, to determine whether an Exelon Nuclear employee at the Limerick Generating Station was discriminated against for having raised concerns regarding Limerick emergency preparedness and the Exelon standard emergency plan. OI found that decisions made by Exelon with regard to the employees work performance and emergency preparedness staffing in general did not appear to be connected to comments submitted by the employee regarding emergency planning. The investigation determined that Exelon sought and received a considerable amount of input regarding implementation of the Exelon standard emergency plan from a number of sources, including the employee. As such, OI found that it was likely that management was aware of the employees concerns. However, it could not be shown that the raising of these concerns by the employee played a part in managements assessment of the employees performance or in the decision to terminate his/her employment.
Based on testimonial and documentary evidence developed during the OI investigation, the NRC concluded that the employee was not discriminated against for having engaged in protected activity.
