ACTION ITEM 9. Confirm Ono indication of land disturbing activities".

STATUS: With regard to Point Beach Nuclear Plant and associated lands, land disturbing activities would occur only if more wetlands are created within farm lands on the property. If additional wetlands are created, the activity will comply with all state and federal requirements. With regard to transmission corridors, no land disturbing activities are anticipated to occur.

Kris McKinney ACTION ITEM 1. Develop response to USFWS letter of 2-26-04.

STATUS: A draft response letter is being developed; NRC will

> be copied on the final letter sent to USFWS.

ACTION ITEM 2. Provide info on 'Tolling Agreemento with

> USFWS and USDOJ.

STATUS: Intemal legal personnel are confirming how much, if

> any, of the tolling agreement is publicly available; copies of annual

> reports submitted as a requirement of the tolling agreement will be mailed

> to NRC.

ACTION ITEM 3. Identify other enforcement agreements, if any, in

> effect for PBNP.

STATUS: Based on our internal review, no other environmental

> enforcement agreements are in effect for PBNP.

ACTION ITEM 4. Provide additional documentation related to the

> closure of the former wastewater retention pond.

STATUS: Five documents with attachments related to the history and

> closure of the former wastewater retention pond will be mailed to NRC.

ACTION ITEM 5. Provide any additional Information related to the

> history and activities of the spoils pile including rad surveys that may

> have been conducted; keep NRC updated on development of spoils

> pile procedure.

STATUS: A radiological characterization survey of the spoils pile is

> expected to be completed during the week of April 26th, 2004; NRC will be

> informed on the status of the radiological characterization survey

> and development of the spoils pile procedure as milestones occur.

ACTION ITEM 6. Keep NRC updated on status of WPDES permitting

> process for PBNP; provide regulatory basis for Hg monitoring requirement.

STATUS: NRC will be notified when WDNR issues the WPDES permit for

> PBNP; a copy of the rule language regarding Hg monitoring will be mailed

> to NRC.

ACTION ITEM 7. Keep NRC updated on status of 316(b) rulemaking and

> our evaluation of the rule's potential impact on PBNP operations.

STATUS: RFPs have been Issued to prospective contractors for work to

> estimate the potential impact of the 316(b) rule on PBNP; NRC will be

> notified when the rule is formally published in the Federal Register

> and when a contractor has been selected.

ACTION ITEM 8. Contact the American Transmission Company (ATC) to

> identify lead ATC staff to support PBLR, Including participation in the

> environmental scoping meetings on June 16-17, 2004.

STATUS: ATC has identified their point of contact for PBLR,

> including participation in the environmental scoping meetings on June

> 16-17, 2004, at PBNP.

ACTION ITEM 9. Confirm "no Indication of land disturbing

> activities".

STATUS: We need additional guidance from NRC as to the information

> needed so we can adequately respond to this action item.

ACTION ITEM 10. Provide Info on hazardous waste and polychlorinated

> biphenyls (PCBs) policies for PBNP.

STATUS: A copy of PCB information filed with an environmental

> regulatory will be mailed to NRC; other information related to this action

> item will be available for NRC and their contractors to review

> during the environmental scoping meeting on June 16-17,2004.
