Dear Mr. Lee:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated April 14, 2004. In that letter, you asked the NRC to classify equipment you intend to export before you apply for an NRC export license to export two D2O feed pumps for ultimate use in the Cernavoda Unit 2 (CANDU-type reactor) nuclear power plant in Romania.

Appendix A to Part 110 describes the reactor components that are under NRCs export licensing authority. The description includes components which normally contain or come in direct contact with the primary coolant of the reactor core. Based on our understanding of the CANDU design and your description of the pumps, this export is under NRCs export authority and is covered under paragraph (9) of Appendix A.

Under the general export license provisions of 10 CFR 110.26, because the pumps are covered by paragraph (9) of Appendix A and manufactured in the United States for use in a CANDU-type reactor in Romania, a specific export license in not required. Romania has provided the broad generic assurances which satisfy relevant U.S. export licensing criteria that allow exports of this type to be conducted under a general license.

Under general license authority an application is not normally submitted and no formal export licensing documents are issued by the NRC. According to 10 CFR 110.26(d), those who utilize general license authority to export reactor components are required to submit annual reports to the NRC by February 1 of each year, listing all components shipped during the previous calendar year. The report should include a description of the components, approximate shipment dates, and a list of recipient countries and end users keyed to the items shipped.

The NRCs import/export regulations in 10 CFR Part 110, which can be found on the NRCs public Web site at http://www.nrc.gov/reading-rm/foc-collections/cfr/part110/. In particular, I recommend that you review the general information provided in Section 110.2, Definitions, Section 110.9, List of nuclear material under NRC export licensing authority, Section 110.19,
