REQUEST FOR HEARING WITH RESPECT TO EA-03-214, A CONFIRMATORY ORDER MODIFYING THE LICENSE FOR DAVIS-BESSE Attached is a petition to intervene submitted by Paul Gunter on behalf of the Nuclear Information and Resource Service, Michael Keegan, Joanne DiRando and Donna Lueke. The individual petitioners live in the vicinity of the Davis-Besse Nuclear Power Station (Docket Number 50-346). The concern of the petitioners is EA-03-214, an immediate effective Confirmatory Order Modifying the license for Davis- Besse. The Confirmatory Order describes the steps taken by the Licensee to correct certain plant structural and safety defects. The Order was published in the Federal Reqister at 69 Fed. Reg. 12357 (March 16,2004).

The petition to intervene is being referred to you for appropriate action in accordance with 10 CFR §2.346(i).
