Caldwell (NRC) to Thomas Coutu (NMC), "NRC Inspection Report 50-305/02/07(DRS)," dated June 19, 2003 In Reference 1,the Nuclear Regulatory Commission (NRC) provided Nuclear Management Company (NMC) with the results of inspection activities conducted from October 21 through November 8, 2002. Included in the findings of the report were two Non-Cited Violations (NCVs). In reference 2, NMC responded to the NRC denying, in part, the NCV related to inadequate separation of safety related controls and power to two cooling water control valves. In reference 3, NRC informed NMC that they did not agree to the basis for NMC's denial and upheld the 10 CFR Part 50, Appendix B, Criterion IlIl violation.

This letter is to inform NRC that NMC no longer denies the violation. Corrective actions needed to reconcile the design of the affected control circuit with the Kewaunee plant design bases are being processed through the plant's corrective action process.
