PFCT'f 04 HAR 30 AH 10: 27 March 15, 2004 Mr. Nils Diaz, Chairman U. S. Regulatory Commission Washington, D.C. 20005

Dear Chairman Diaz,

I am writing to you because I have serious concerns regarding Entergy's Vermont Yankee nuclear power plant.

As you know, Entergy has applied to the NRC for approval to operate at 120% of the plant's design capacity. Vermont Yankee was designed in 1967, five years before the final design and safety criteria were formalized by the NRC. VY could not be built or licensed today as it was designed in 1967. Entergy wants to whip another 20% out of this old technology? Is this prudent? None of my friends or neighbors think so.

Several nuclear engineers have expressed alarm with a number of already marginal containment systems designs and their ability to handle the addition of 20% more nuclear fuel. Also, VY is now seriously short of spent rod storage space.

I am hoping that with your help we can get an independent safety audit of this aging nuclear power plant. Entergy has not proven to be a good neighbor. There is too little margin for error when dealing with radioactivity. There are too many questions. We need the clear answers that will only be provided by a thorough independent review of all VY systems.

Thank you for your help.

Sincerely, Carolyn M. Freed I,[&
