An internal panel meeting was held on February 27, 2004. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, and the Open Action Items List.

Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE:

Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

2.

Discuss Plant Status and Inspector Insights and Emergent Issues List C. Thomas updated the panel on Inspector Insights and Emergent Issues. Also, he updated the panel on the licensees recent brief to him on the status of their 50.9 scope expansion. Approximately 63 documents and over 500 statements of fact are being verified. No issues needing to be reported have been identified thus far.

Discuss Communications Status The panel discussed the new 2/25/04 S. Buchanan and Lochbaum letter and that this will be responded to before restart along with the 2/12/04 OCA/S. Buchanan letter. Also discussed that there are names in the 2/25/04 letter that need to be supplied to OI (R.

Paul). Other documents were discussed and the panel decided that they were post restart related correspondence.

Discuss Status of CATI Report Decision was made that since the report is not on track to be ready soon, the Panel needs an Inspection Results Memo to support the presentation at the 2/5/04 panel meeting where the CATI team recommended closure of the checklist item 3.a. Julio Lara has this action. Estimated date of draft to Panel today, with approval of CATI team members. This policy is similar to other memos being used for checklist items closed by panel, but not in published reports to support the estimated restart decision time frame.

Discuss EP Office Response Concerning FEMA Issue Panel discussion of change to a decision made on 2/25 regarding the new incoming concern about the 800 Mhz communications system. That decision was that we needed to check with FEMA before a decision on restart. Several panel members held a group conference based on emails attached to these minutes and the recommendation

from Nader Mamish in the NRR Emergency Preparedness Office. His recommendation was that the recent concerns do not need an immediate call to FEMA and can be followed up in the normal manner. The panel agreed with this recommendation based on the lack of specificity in the concern and recent inspections and graded exercises of Emergency Preparedness have not revealed any concerns.

Discussion of Action Items Item 244 (Closed) - Security (J. Creed) contact NSIR to determine if DHS needs notification at restart as an applicable Federal Agency. (2/10)

Action Item 244 is closed based on Creeds followup with NSIR. DHS has been added to the restart communications plan.

Item 245 (Closed) - NRR contact FEMA to verify there are still no objections to restart.

Action item 245 is closed based on discussion in #5 above.

Item 246 (Closed) - Verify which remaining meetings of all special inspection team leads with the RA exist. (2/10)

Action item 246 is closed based on final meeting with Jim Caldwell by D. Passehl, team lead for completeness and accuracy of information inspection. This meeting was held 2/27 and covers all team leads for all special inspections in 2002, 2003, up through today.

Item 252 (NEW) - Need to document when we have completed reading all the 1000s of letters from OCA (2/27)

New Action Item added to document when all of the 1000s of letters received from folks in Ohio and other places, based on the Ohio Citizen Action groups efforts have been read. Jim Caldwell had read many letters and all panel members had read many of them. All letters must be read before restart decision, including the letters received at public meeting in January and February. J. Strasma has the action to report to panel when all are read.

Item 253 (NEW) - Publicly release promptly all documents that need to go public as specified in IMC 0350 (2/27)

New Action Item added to promptly publicly release all documents that are required to be released by the 0350 procedure upon a restart approval and this is assigned to D.

Passehl.

Review Key Items Scheduled for Next Panel Meetings Discussion of next panel meeting to be held Monday 3/1 10-12 EST. Topics to include J. Laras Inspection Results Memo, the status of correspondence, such as OCA letters (3) and the Gunter letter.

Discuss Recent Allegations Discussion of recently received allegations. There were 4 documents received in the recent few days that could be considered as allegations. The panel discussed each one compared to the criteria the panel uses to screen allegations as restart related vs. post -

restart related. None of the items was determined to need resolution prior to restart and will follow normal process.

Attachment to Panel Minutes 2/27/04 Recommendation from EP Project Office February 26, 2004 This confirms that Christine Lipa and I have discussed the position of the NRR emergency preparedness staff and management described below in the e-mail from Jon Hopkins and also agree that the recent concern regarding EP communications should be handled in a normal followup manner; that no immediate call to FEMA is necessary to obtain FEMA view of concern before restart of Davis-Besse. I also understand that Bill Ruland and the NRR members of the Davis-Besse Oversight Panel also agree that this matter is not a restart constraint.

Consequently, recognizing that this was the final constraint prior to my signing the restart recommendation to Jim Caldwell on behalf of the Panel, I will sign that recommendation today.

This decision will be reflected in the next Oversight Panel internal meeting minutes.

Jack E-mail from Jon Hopkins dated 2/26/2004:

I have just spoken with the NRR Emergency Preparedness Project Office.

The EPP Office (Nader Mamish) view is that the recent concern regarding EP communications should be handled in a normal followup manner. No immediate call to FEMA is necessary to obtain FEMA view of concern.

This view, is in part, due to the absence of specificity in the concern that would differentiate it from other general EP concerns received by the NRC. Additionally, most of the EP concerns forwarded to FEMA are not substantiated.

My view, is that in addition to the above, there are graded EP exercises every two years and weaknesses observed in the exercises are addressed. The last exercise at Davis-Besse was in June 2003. Also, NRC staff just performed an inspection of EALS that did not reveal significant problems. Therefore, I conclude that it is very unlikely that there is a significant problem with EP at Davis-Besse including offsite EP communications.
