Davis-Besse Nuclear Power Station Emergency Plan and Emergency Implementing Procedures Ladies and Gentlemen:

During an evaluation of the Emergency Preparedness program by the Davis-Besse Nuclear Quality Assessment staff, in accordance with IOCFR50.54(t), an oversight was discovered in transmission of the Davis-Besse Nuclear Power Station (DBNPS) Emergency Plan and Emergency Implementing Procedures per 10 CFR 50.4. Although the Emergency Plan and Emergency Implementing Procedures have been transmitted to the NRC Region III Office and Headquarters through our Document Control staff, the plan and procedures have not been recently transmitted in accordance with the DBNPS regulatory process to ensure compliance with 10 CFR 50.4. The enclosed Emergency Implementing Procedures and Emergency Plan were current as of February 18, 2004.

This condition was entered in the DBNPS Corrective Action Program to be evaluated and corrected. To rectify this condition please find enclosed current copies of the DBNPS Emergency Plan (Revision 22) and the Emergency Implementing Procedures, Volumes A, B, and C (the Emergency Implementing Procedures also contain the DBNPS Off-Normal Procedures and are included in this submittal). Although distribution of the Emergency Plan and Emergency Implementing Procedures to the NRC was not administratively in accordance with 10 CFR 50.4, the process of changing the plan has been completed in accordance with 10 CFR 50.54 (q). The DBNPS process requires review of the changes to ensure no decrease in effectiveness of the plan. FENOC understands the regulation allows the licensee to make changes to the Emergency Plan without NRC approval only if the changes do not decrease the effectiveness of the plan. The DBNPS Emergency Plan, as changed, continues to meet the requirements of 10 CFR 50.47 (b) and 10 CFR 50, Appendix E.
