Mr. Bruce Mallett Regional Administrator U.S. Nuclear Regulatory Conmission, Region IV Texas Health Resources Tower 61 I Ryan Plaza Drive, Suite 4005 Arlington, Texas 760 11-8064 RE: Callaway Plant Reactor Trip, Event No. 40500
Dear Mr. Mallett:
This is to express our concern with the failure of the U S. Nuclear Regulatory Commission (NRC) to notify the State of Missouri in a timely manner with regard to the above-referenced event that occurred at Missouri's Callaway Nuclear Plant early in the morning of Tuesday, February 3,2004.
The NRC's first communication with a Missouri official to provide infonnation concerning this event at the Callaway Plant did not occur until after 4 p.m. on Thursday, February 5, 2004. According to the Preliminary Notification of Event or Unusual Occurrence (PNO-IV-04-006) that the NRC Region 1V Office faxed to the designated Missouri official at 5:46 p.m. on February 5, 2004. "Region IV received notification ofthis occurrence...at approximately 5:30 a.m. on February 3, 2004."
We would very much appreciate being informed ofthe reasons for not being provided infonnation related to these events of February 3, 2004, at the Callaway Nuclear Plant until over 4X hours later.
Thai& you for your attention to this important matter.
Sincerely, DEPARTMENT OF NATURAL RESOURCES Deputy Director for Policy and NRC State Liaison Officer RK:jni c: Mr. Stephen Mahfood, Director, Missouri Department of Natural Resources Mr. Paul 11. Lohaus, Director, Office of State and Tribal Programs Integrity nnri excellence in all we do 0
