SUMMARY
OF FEBRUARY 26, 2004, MEETING REGARDING THE RESOLUTION OF BROWNS FERRY UNIT 1 LICENSE CONDITION IN THE IMPROVED TECHNICAL SPECIFICATIONS (TAC NO. MC2008)
Background
On February 26, 2004, the U.S. Nuclear Regulatory Commission (NRC) staff met with Tennessee Valley Authoritys (TVAs or the licensees) representative at the NRC Headquarters in Rockville, Maryland. The objective of the meeting was to discuss TVAs proposed resolution for an open item in the Regulatory Framework letter dated August 14, 2003 (ADAMS Accession No. ML032190680) regarding Condition 2.C(4) in License Amendment No. 234 dated July 14, 1998 (ADAMS Accession No. ML020040291), which issued the Improved Technical Specifications (ITS) for Unit 1. The meeting was classified as a Category 1 meeting. is a list of attendees, and Attachment 2, which contains TVAs agenda for the meeting, is a copy of TVAs handout distributed at the beginning of the meeting.
Discussion TVAs representative discussed the history and the purpose of the license condition. The purpose was to allow issuance of the conversion to the ITS for all three units with Unit 1 being in a long-term lay-up condition and to ensure the changes to the Unit 1 ITS identified in the application as lacking the required analysis were supported by the plant design basis prior to returning the associated equipment to service. License Condition 2.C(4) states that:
The licensee shall review the Technical Specification (TS) changes made by License Amendment No. 234 and any subsequent TS changes, verify that the required analyses and modifications needed to support the changes are complete, and submit them for NRC review and approval prior to entering the mode for which the TS applies. This amendment is effective immediately and shall be implemented prior to entering the mode for which the TS applies.
The participants discussed the interpretation of this license condition and its scope. The licensees representative proposed two options, stated on pages 16 and 17 of the handout, for resolution of this license condition. In addition, the participants discussed the potential for an inspection to vertify the conformance between Unit 1 as designed and built and its ITS. This potential inspection would likely be considered as part of NRC inspections prior to the restart of Unit 1.
Conclusion The NRC staff did not make any regulatory decisions during the meeting and will review TVAs proposed resolution in a timely manner.
