Dear Mr. Dragoun:

1,Barry Klein, as Licensee and Acting Director of the University of California, Davis McClellan Nuclear Reactor (UCD/MNRC) do hereby state my intention that the UCD/MNRC will begin the process of submitting a Technical Specification change to the NRC, including the prior approval process by the NSC, which will modify the organizational chart (Figure 6.1) as follows:

The current box entitled "Operations Manager" will be removed from the organizational chart to more accurately reflect the actual current mode of operation, wherein the person currently holding this position does not have the authority to independently make decisions regarding Reactor or Radiation safety. This modification to the Technical Specifications will not alter the current functional (non-NRC related) organization nor eliminate or change the current functional role of the Operations Manager as it relates to non-reactor and non-radiation safety issues.

This change is being made in response to a concern expressed during the NRC Audit 2004-201. The current practice was determined to not meet the current Technical Specification requirements. Upon being brought to the UC Davis management's attention, this straightforward solution was decided upon and is being implemented immediately in an effort to be responsive to the NRC's concerns. The NSC committee chairperson and committee members will be requested to review this change.

I believe that these changes to our current Technical Specifications will improve our continuing efforts to ensure that the UCD/MNRC facility meets or exceeds all regulatory requirements.
