Dear Mr. Kanda:
This letter confirms the discussion between Ms. P. Lougheed of this office and Mr. V. Higaki of your staff to have a predecisional enforcement conference on Tuesday, March 2, 2004, at 9:00 a.m. (CST) in the Region III Office, Lisle, Illinois. This meeting was rescheduled from February 4, 2004, based on your request. The purpose of this meeting is to discuss an apparent violation of the Technical Specification overtime requirement on March 12 and March 13, 2001, when apparently FENOC employees and employees of a FENOC contractor deliberately failed to obtain prior approval for overtime and deliberately falsified information on related time cards. The meeting will be closed to public attendance but will be transcribed, because it involves the findings of an Office of Investigations report that has not been publicly disclosed.
In accordance with 10 CFR Part 2.790 of the NRC's Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). Additional details regarding the apparent violation were provided in our December 19, 2003, letter to you (ADAMS Accession number ML033560448).
